TERMS OF SERVICE

These Terms of Service (“Terms”) govern access to and use of Atlassync software, websites, installation tools, dashboards, updates, and related services provided by Volantis LLC (“Volantis”, “we”, “us”, or “our”).

By creating an account, installing or using Atlassync, or purchasing a subscription, you agree to these Terms.

1. THE SOFTWARE

Atlassync is downloadable automation software designed to operate in a compatible Windows or VPS environment controlled by the customer.

The Atlassync service may include:

2. CUSTOMER ENVIRONMENT

You are responsible for providing and maintaining the computer, VPS, operating system, third-party applications, internet connection, accounts, and other infrastructure required to use Atlassync.

Third-party products and services are provided independently and are governed by their own terms.

Volantis does not control the availability, performance, pricing, policies, or continued compatibility of third-party services.

3. ACCOUNT

You must provide accurate information when creating an Atlassync account.

You are responsible for maintaining the security of your account credentials and for activity performed through your account.

You must notify us promptly if you believe your account or credentials have been compromised.

4. SOFTWARE LICENCE

Subject to these Terms and an active trial or subscription, Volantis grants you a limited, non-exclusive, non-transferable, revocable licence to install and use Atlassync for your own use.

You may not:

5. 30-DAY TRIAL

Eligible new users may use Atlassync for a 30-day trial period.

The trial begins when an Atlassync installation is successfully activated for the first time.

No payment card is required to begin the trial.

The trial does not automatically convert into a paid subscription.

Before the trial expires, you may choose whether to purchase a subscription. If you do not purchase a subscription, you will not be charged and the software licence will expire when the trial ends.

6. SUBSCRIPTIONS AND PAYMENT

After the trial, Atlassync may be purchased as a monthly software subscription.

The current subscription price is displayed before purchase.

A subscription begins only after you actively choose to subscribe and complete the payment process.

Subscriptions renew monthly until cancelled.

You authorize our payment provider to charge the payment method you provide for each renewal.

Applicable taxes may be added where required.

7. CANCELLATION

You may cancel your subscription at any time through the available account controls or by contacting us.

Cancellation stops future renewals.

Unless otherwise required by applicable law, your licence remains active until the end of the period already paid for.

8. REFUNDS

Refunds and billing corrections are governed by our Refunds & Cancellation Policy.

Nothing in these Terms limits rights that cannot legally be excluded under applicable consumer law.

9. SOFTWARE OPERATION

Atlassync performs automated functions according to its software logic, configuration, available data, and the environment in which it operates.

Automated software may behave differently as external conditions, third-party systems, connectivity, configuration, or available data change.

You are responsible for deciding whether Atlassync is appropriate for your intended use and for monitoring your own installation.

You can stop or disable your installation at any time through the environment in which it is running.

10. THIRD-PARTY SERVICES

Atlassync may interact with software, infrastructure, platforms, or services supplied by third parties.

Those services are independent from Volantis.

Changes, outages, restrictions, errors, incompatibilities, or discontinuation of third-party services may affect Atlassync functionality.

Volantis is not responsible for third-party services or for losses caused solely by their operation or unavailability.

11. UPDATES AND AVAILABILITY

We may update Atlassync to improve functionality, security, compatibility, or reliability.

Updates may modify or remove existing functionality.

We aim to keep Atlassync and its related online services available, but uninterrupted or error-free operation is not guaranteed.

Temporary interruptions may occur because of maintenance, updates, technical problems, third-party outages, or circumstances outside our reasonable control.

12. CUSTOMER RESPONSIBILITY

You are responsible for:

13. NO GUARANTEE OF RESULTS

Software performance depends on many factors outside Volantis's control, including configuration, external systems, connectivity, data, and operating conditions.

Volantis does not guarantee any particular result, performance level, availability, outcome, or benefit from use of Atlassync.

Past operation of the software does not guarantee future operation or results.

14. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, Atlassync is provided on an “as is” and “as available” basis.

Volantis disclaims warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent such disclaimers are permitted by law.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Volantis will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, business opportunities, or use arising from or related to Atlassync.

Where liability cannot legally be excluded, Volantis's aggregate liability arising from the Atlassync service will, to the extent permitted by law, be limited to the subscription fees paid by you to Volantis during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

16. SUSPENSION AND TERMINATION

We may suspend or terminate access where reasonably necessary because of:

18. CHANGES TO THESE TERMS

We may update these Terms from time to time.

Material changes will be communicated through the website, account interface, email, or another reasonable method before they take effect where required.

Continued use after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.

19. GOVERNING LAW

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws provide otherwise.
